Environmental Searches are considered advisable.... Environmental Searches are considered advisable by many property lawyers. However, many property owners still do not instruct their solicitors to carry one out. There is an option of environmental liability insurance available, but we would submit that instructions to effect an environmental desktop survey before a commitment to proceed are the preferred option for our clients. Searches can be obtained quickly and at a relatively nominal cost. The advice outlined above is given generally across the board, and applies to property purchases ranging from a private dwelling to the acquisition of a short term leasehold interest in part of a building where service charge provisions may allow recovery of remediation costs.
